Who Qualifies?

Through a process called declaration via Section 31 (sometimes erroneously referred to as “Czech citizenship by descent”), individuals with Czech ancestry can regain citizenship without taking the traditional naturalization steps. You may qualify if:

  • One of your parents or grandparents was a Czech or Czechoslovak citizen AND they lost their citizenship through U.S. naturalization OR your qualifying female ancestor married a non-Czechoslovak citizen before June 24, 1947, AND
  • Your qualifying ancestor never became a Slovak citizen in 1969, AND
  • You currently are not and never have become a Slovak citizen.
 

You may also qualify via Section 32 if:

  • Your non-Czech grandmother married a Czechoslovak citizen before June 24, 1947, OR
  • Your grandparent was born abroad to Czechoslovak parents before 1949.

What’s Required?

To apply, you’ll need:

  • Birth, marriage, and death certificates for everyone in your direct Czech line going as far back as your last Czech ancestors to have resided in Czechoslovakia or Czech Republic.
  • Proof of your ancestor’s Czech citizenship (e.g., census, passport, or immigration records).
    Proof of loss of Czech/Czechoslovak citizenship (e.g. a naturalization certificate or a marriage certificate if woman married before June 24, 1947).
  • Supporting documents for yourself and any children applying with you. (Keep in mind that only grandchildren of a qualifying ancestor are eligible).
 

What’s more, there is no requirement to live in the Czech Republic or speak Czech in order to qualify!
